MISDEMEANORS

Misdemeanors are lesser crimes, but can nonetheless have an impact on your life. Some people who self-represent themsleves before a judge on a misdemeanor charge believe that they will have a small penalty.

 

In fact, if not represented by an attorney, you may not understand the exact ramifications of resolving a criminal case. You could have a permanant criminal record, if convicted; and there is the possibility of being sentenced to jail. Depending on the circumstances and whether your are first-time or repeat offender, our firm may be able to get the case dismissed.

 

Misdemeanor crimes can be punishable by up to one year in jail, one year probation, or up to $1,000 fine.

 

FELONIES

A felony is the most serious crime, punishable by death or by more than one year in prison. Depending on the nature of the alleged crime, a felony may be governed by federal law and tried in the federal court, or governed by a state law and tried in a state court.

 

Convicted felons lose certain rights, including voting, owning a gun, being ineligible for federal loan programs, as well as incurring in low credit scores and having difficulty finding employment.

EXPUNGING & SEALING RECORDS 

Depending on your age at the time of the offense and the type of crime, misdemeanor and some felony arrest records can be sealed or expunged.

 

The Florida Statute 943.0585 provides the conditions and requirements for the expungement of criminal records. Expungement allows the sealing of court cases and allows a person to comment that a crime was never committed. If a person has been convicted of a crime then expungement is not allowed.
